Simply Construction Services Terms and Conditions
These Simply Construction Services Terms and Conditions (“Terms”) apply to each request for services (“Request for Services”) submitted to Simply Construction for the provision of services (“Services”) to one or more individuals.
In these Terms, the individual submitting the Request for Services may be referred to as “you,” while Simply Construction will be referred to as “Simply Construction,” “we,” or “us,” and the individual receiving Services is referred to as a “Client.”
By requesting or using our Services, you agree to these Terms in full. Please read them carefully before submitting any Request for Services.

Payment for Services. Payment must be received at the time a Request for Services is submitted and before any Services are provided. You are responsible for any applicable taxes related to the purchase or use of Services. Requests for Services may be submitted electronically via our website or by email.

Scheduling and Cancellation. You may schedule Services via email or by phone. Simply Construction will confirm scheduled Services via email. Services may be rescheduled or canceled with at least 24 hours' notice. If less notice is given, Services will proceed as scheduled, and no refund will be provided.

Subscriptions. Services may be ordered on a one-time basis or through a subscription plan (weekly, monthly, or annually). Subscriptions automatically renew unless canceled. If payment cannot be processed, you remain responsible for any outstanding amounts. We reserve the right to cancel your subscription if payment is not received.

Role of Simply Construction. Simply Construction arranges for Services through third-party qualified service providers (“Providers”). We do not directly provide any Services.

Privacy. Your use of Services is subject to our Privacy Policy, available on our website.

Term and Termination. These Terms and each Request for Services submitted form an agreement (“Agreement”). You may terminate the Agreement with 48 hours' notice. We may terminate the Agreement with at least 10 days' notice. If you violate these Terms, we may terminate the Agreement immediately, and you will remain responsible for any unpaid amounts.

Force Majeure. We and our Providers are not liable for delays or non-performance due to events beyond our control, such as government actions, pandemics, natural disasters, labor strikes, or shortages.

Liability. Simply Construction and its affiliates are not liable for any claims, damages, losses, or liabilities arising from your actions, instructions, or third-party involvement. You agree to indemnify and hold us harmless from any related claims.

Indemnity. You agree to indemnify and defend Simply Construction, its affiliates, and service Providers from any claims, liabilities, losses, expenses, damages, or costs, including legal fees, resulting from your actions under this Agreement.

Governing Law. These Terms are governed by the laws of the Province of Ontario and applicable federal laws of Canada.

Jurisdiction. You agree that any legal disputes must be filed in the courts of Ontario. You waive any objections to jurisdiction or venue.

Severability and Waiver. If any part of these Terms is deemed invalid or unenforceable, the remaining provisions remain in effect. No waiver of any term shall be deemed a further or continuing waiver of such term or any other term.

Entire Agreement. These Terms and any Request for Services constitute the entire agreement between you and Simply Construction regarding the Services, superseding any prior agreements.
